Heard learned AAG and perused the material available on the record

The present petitioners have been arrested in FIR No. 74/2023 of Police Station Banad, Jodhpur for the offences punishable under Sections 420, 116, 120B IPC read with Section 10(2) of the Rajasthan Public Examination Act. They have preferred these bail applications under Section 439 Cr.P.C.

The allegation against the petitioners is of leaking of question paper.

Learned AAG submits that if the petitioners are enlarged on bail then it would be difficult to complete the investigation, as the loose end of the justice would be difficult to be tied down.

This Court, looking to the vast consequences of the allegations made against the present petitioners, and the mistrust created amongst the youths, who had participated in the selection process with respect to the public examination in question and the fact that the State Legislature in its wisdom has enacted a specific legislation i.e. Rajasthan Public Examination Act, 2022 to combat such growing problem in society, this Court is not inclined to grant bail under Section 439 Cr.P.C. to the petitioners, at this stage.

However, the petitioners are at liberty to come before this Court after filing of charge-sheet.

Dismissed accordingly.
