This application for bail has been filed by the petitioner under Section 439 of Cr.P.C. in connection with FIR No.53/2023 registered on 25.02.2023 at Police Station Mandore, Jodhpur East for the offences under Sections 419, 420, 465, 468, 471 & 120-B of IPC and Section 2(च)(II), 3, 7 & 10 of Rajasthan Public Examination Act, 2022.

Learned counsel for the petitioner submits that first bail application of the petitioner was rejected by this Court vide order dated 17.03.2023 however, liberty was granted to the petitioner to come before this Court after filing of charge-sheet. Learned counsel for the petitioner further submits that now, charge-sheet has been filed and the petitioner has no previous criminal antecedents and no recovery is due against the petitioner.

Learned Public Prosecutor opposes the bail application however, not in a position to dispute the submissions made by learned counsel for the petitioner.

Heard learned counsel for the petitioner and learned Public Prosecutor and also perused the material available on record. 5. This Court, having regard to the facts and circumstances of the case and without expressing any opinion on merits/demerits of the case and looking to the fact that the trial will take long time, is of the opinion that the second bail application filed by the petitioner deserves to be accepted.

Consequently, the second bail application filed under Section 439 Cr.P.C. is allowed. It is ordered that petitioner Gopal Singh Bhadu S/o Tejpal Singh, shall be released on bail in connection with the aforesaid FIR; provided he executes personal bond in the sum of Rs.50,000/- and two sureties of Rs.25,000/- each to the satisfaction of the learned trial Court. Petitioner shall be required to appear before that Court on all dates of hearing and as and when called upon to do so.
