This application for second bail has been filed by the petitioner under Section 439 of Cr.P.C. in connection with FIR No.68/2023 registered on 14.03.2023 at Police Station Lalgarh Jattan, District Ganganagar for the offences under Sections 8/22 and 8/29 of NDPS Act.

Learned counsel for the petitioner submits that first bail application of the petitioner was rejected by this Court vide order dated 20.03.2023 however, liberty was granted to the petitioner to come before this Court after filing of charge-sheet. He further submits that charge-sheet has been filed and the recovered contraband is of below commercial quantity. He further submits that the co-accused Jagmeet Singh @ Jagjeet Singh has already been enlarged on bail by a co-ordinate Bench of this Court vide

order dated 01.05.2023 in S.B. Criminal Misc. Bail Application No.4820/2023.

Learned Public Prosecutor does not dispute the fact that charge-sheet has been filed and the recovered contraband is of below commercial quantity. 4. Heard learned counsel for the petitioner and learned Public Prosecutor and also perused the material available on record.

This Court, having regard to the facts and circumstances of the case and without expressing any opinion on merits/demerits of the case and looking to the fact that the trial will take long time, is of the opinion that the second bail application filed by the petitioner deserves to be accepted.

Consequently, the second bail application filed under Section 439 Cr.P.C. is allowed. It is ordered that petitioner Rekha @ Karamchari W/o Sh. Rakesh @ Gabri, shall be released on bail in connection with the aforesaid FIR; provided she executes personal bond in the sum of Rs.50,000/- and two sureties of Rs.25,000/- each to the satisfaction of the learned trial Court. Petitioner shall be required to appear before that Court on all dates of hearing and as and when called upon to do so.
