1. This is the second application for bail which has been filed under Section 439 Cr.P.C. on behalf of the petitioners, who are in custody in connection with F.I.R. No.24/2023 dated 09.02.2023, registered at Police Station Sadar, District Nagaur, for the offences punishable under Sections 341, 323, 365, 342 and 325/34 of the IPC.

2 . The first application for bail was dismissed by this Court vide order dated 20.03.2023, however, the petitioners were granted liberty to come before this Court after filing of the charge-sheet.

3 . Learned counsel representing the petitioners, submits that now, the charge-sheet has been filed in this case. He further submits that no recovery is pending against the petitioners and

the injuries caused to the complainant-Ashok, are not life threatening.

4. Per contra, learned Public Prosecutor opposes the bail application. However, he too is not in a position to dispute the aforementioned facts as pointed out by the learned counsel representing the petitioners.

In view of the above and, having regard to the entirety of facts and circumstances of the case as available on record and looking to the fact that the trial will consume time and without expressing any opinion on the merits and demerits of the case, this Court is of the opinion that the petitioners deserve to be enlarged on bail.

6 . Consequently, the instant second bail application filed under Section 439 Cr.P.C., is allowed. It is ordered that the accusedpetitioners viz . (1) Pappuram S/o Bhagwnaram and (2) Nainaram S/o Motaram , arrested in connection with F.I.R. No.24/2023 dated 09.02.2023, registered at Police Station Sadar, District Nagaur, shall be released on bail; provided each of them furnishes a personal bond in the sum of Rs.50,000/- and two surety bonds of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
