The instant habeas corpus petition has been preferred by the petitioner Smt. Khetu Devi, seeking a direction for production of her minor daughter Mst. ‘K’ in this Court. A direction was given to the learned AAG to ensure production of the corpus who has been produced in the Court today. We conferred with the corpus “in camera”. She expressed a desire to go to her parental home but

while ensuring that she is not forced to marry till she attains the age of majority and even thereafter, her wishes are respected.
In consequence of the said statement of the girl, counsel Shri Charan has filed affidavit of Shri Ramu Ram, father of the girl and Khetu Devi her mother undertaking not to compel the girl to marry till she attains the age of majority and to continue her education.
In view of the above situation, we hereby direct that the corpus Mst. ‘K’ shall be permitted to proceed with her parents. The SHO Police Station Dhorimanna, District Barmer shall ensure fortnightly visits of a female constable to the house of the petitioner so as to ensure the well being of the corpus. It shall also be ensured that the girl is not married off till she attains the age of majority and her education is continued.
The habeas corpus petition is disposed of in these terms.
