By way of this writ petition, filed under the nomenclature of Public Interest Litigation, the petitioner has questioned allotment of a land in Sector No.4, Hiran Magri, Udaipur to the respondent No.4 Rajasthan Shikshak Sangh, Udaipur. The petitioner has set up a case that the land in question is being used as a park by the citizens of the area and thus, the allotment made to the respondent No.4 Sangh is absolutely unjustified.

The respondents have filed reply to the writ petition wherein, it is asserted that the land in question was never reserved as a park. The allotment in favour of the respondent No.4 was made way back in the year 1972 and lease deed was also executed. An objection is raised by the respondents that the lease deed issued in favour of the respondent No.4 has not been challenged by the petitioner and thus, the writ petition is not maintainable.
At this stage, Shri Mathur, Advocate representing the petitioner craves liberty of the Court that he may be allowed to withdraw the writ petition leaving the petitioner at liberty to take recourse of the suitable remedy for ventilating his grievances.
Accordingly, the writ petition is disposed of as withdrawn with the liberty prayed for.
