This anticipatory bail application has been filed under Section 438 of Cr.P.C. in connection with FIR No. 273/2020 registered at Police Station Malarna Dungar, District Sawai Madhopur for the offences under Sections 332 and 353 of IPC.

Learned counsel for the petitioners submits that it is a case of no injury and the petitioners have no criminal antecedents. Learned counsel further submits that the petitioner No.1-Firoza, petitioner No.2-Parbana and petitioner No.4-Firdos @ Firro are women of 36, 32 & 58 years of age respectively and petitioner No.3-Matlub is 62 years of age. Learned counsel further submits that interim protection from arrest had been given to the petitioners by the Co-ordinate Bench of this Court vide its order

dated 20.06.2022, which was in force till 04.11.2022. Hence, the anticipatory bail application of the accused-petitioners may kindly be granted.

On the other hand, learned Public Prosecutor has opposed the bail application.

Heard learned counsel and perused the material available on record.

¶20

Considering the submissions made by the learned counsel for the petitioners and looking to the facts and circumstances of the case but; without expressing any opinion on the merits and demerits of the case, I deem it just and proper to enlarge the petitioners on anticipatory bail.

Accordingly, this anticipatory bail application is allowed and it is ordered that in case of arrest of the accused-petitioners in FIR No. 273/2020 registered at Police Station Malarna Dungar, District Sawai Madhopur by the Investigating Officer, the accusedpetitioners shall be released on bail; provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs. 25,000/- each to the satisfaction of concerned SHO/IO on the following conditions:

i) That the petitioners will make themselves available for the investigation as and when required by the investigation officer.

ii) That the petitioners will not leave India without permission of the Court.

¶24

iii) That the petitioners will not tamper with the evidence or threaten or pressurize the witnesses in the case.
