This bail application has been filed under Section 439 Cr.P.C in connection with FIR No.165/2022 registered at Police Station Bhimganj Mandi, District Kota City for the offences under Sections 363, 365, 308, 34, 376(3) & 376(2)(n) of I.P.C. and under Sections 3/4 & 5L/6 of POCSO Act.

Learned counsel for the petitioner submits that the chargesheet has been filed. The petitioner is behind the bars since 04.07.2022. The petitioner has criminal antecedents of two cases and in both the cases, he has already been enlarged on bail and both the parties have settled their dispute amicably, hence, the petitioner may be released on bail.

whereas learned counsel for the complainant has no objection if the bail application of the petitioner is allowed.

Heard learned counsel for the parties and perused the material available on record.

Considering the submissions made by learned counsel for the petitioner as well as learned counsel for the complainant and taking into consideration the overall facts and circumstances of the case but without expressing any opinion on the merits/demerits of the case, this court deems it just and proper to enlarge the petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner- Sonu Tamboli S/o Late Shri Suresh Tamboli, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
