These bail applications have been filed under Section 439 Cr.P.C in connection with FIR No.210/2021 registered at Police Station Roopangarh, District Ajmer for the offences under Sections 302 & 201 read with Section 34 of I.P.C.

Learned counsel for the petitioners submits that the first bail application of Smt. Gora Devi filed under Section 439 of Cr.P.C. was dismissed by the Co-ordinate Bench of this Court vide its order dated 29.03.2022. Counsel submits that the present petitioners are not named in the FIR. There is no direct evidence against the petitioners and they have no criminal antecedents.

Nothing has been recovered from both the petitioners. Counsel further submits that charge-sheet has been filed and both the parties have settled their disputes amicably. The petitioners are behind the bars since 07.09.2022 and the conclusion of the trial will take time, hence, the petitioners may be released on bail.

Learned Public Prosecutor has opposed the bail applications whereas learned counsel for the complainant has no objection if the bail applications of the petitioners are allowed.

Heard learned counsel for the parties. Perused the material available on record.

Considering the submissions made by learned counsel for the petitioners as well as learned counsel for the complainant and taking into consideration the overall facts and circumstances of the case but without expressing any opinion on the merits/demerits of the case, this court deems it just and proper to enlarge the petitioners on bail.

Accordingly, the bail applications filed under Section 439 Cr.P.C. are allowed and it is ordered that the accused-petitioners-

(1) Nandaram Son Of Devaram & (2) Smt. Gora Devi Wife

¶26

Of Nandaram, shall be enlarged on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial judge for their appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
