1. The instant bail application has been filed by the petitionerVishal @ Dholya S/o Shri Om Prakash Paridwal, under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No.223/2021 registered at Police Station Udyog nagar, Kota, for the offence under Sections 143, 341, 323, 307 of IpC.

Learned counsel for the .petitioner submits that a false case has been alleged foisted against the petitioner, he has nothing to do with the offence. He submits that as per the allegations, the petitioner inflicted injury upon the head of the victim in juxtaposition the injury report reveajls that injury Nos.1 and 2 were lacerated, the injury Nos.3 and:4 were abrasions, he submits that all the injuries could ,hawe: be.eg caused by a wea on having & p&lLac( q*d blunt object. Thus, the~e is-a direct: cqnflict in between the ocular n rge-sheet evidence regarding injury-repor$, After, investigation,

has been filed. He is behind the bars his further incarceration would not require.

Per contra, learned Public Prosecutor opposed the bail application.

Considering the arguments advanced by the counsel for the parties and looking to the possibility that the trial may take long time to conclude, this court deems it just and proper to enlarge the petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner named above shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial ludge for his appearance befol-e the court concerned on all the dates of hearing as and when called upon to do so.
