The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-petitioner-Vikash @ Vicky S/o Kishan Lal. The petitioner has been arrested in connection with FIR No.268/2021 registered at Police Station Patan, District Sikar for the offence(s) under Sections 148, 149 & 302 of I.P.C. and under Sections 3/25 & 3/27 of Arms Act.

Learned counsel for the petitioner submits that a false case has been foisted against the petitioner. He has nothing to do with the alleged offence(s) and no useful purpose would be served by keeping him behind the bars. Learned counsel submits that petitioner is not named in the FIR. There is no evidence against the petitioner even for namesake. Neither he was present at the spot nor there is any direct or circumstantial evidence to connect the petitioner with the alleged crime.

Per contra, learned Public Prosecutor and learned counsel for the complainant have vehemently opposed the bail application. Learned counsel for the complainant submits that the gun from which the principal accused committed the offence was procured by the petitioner, therefore, he shall not be released on bail.

Considering the arguments advanced by the counsel for the parties and looking to the possibility that the trial may take long time to conclude, this court deems it just and proper to enlarge the petitioner on bail.

Accordingly, the second bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner, named above, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
