This anticipatory bail application has been filed under Section 438 Cr.P.C. in connection with FIR No. 713/2021 registered at Police Station Udyog Nagar Sikar, District Sikar for the offences under Sections 143, 149, 341, 323, 354, 327, 427 and 307 of IPC.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR and he has no criminal antecedents. Learned counsel further submits that the co-accused Sanjay and Rajesh have already been enlarged on bail by the learned trial Court under Section 439 Cr.P.C. vide its orders dated 25.11.2021 and 26.11.2021. Learned counsel also submits that interim protection from arrest has already been granted to the petitioner by the co-ordinate Bench of this Court vide order dated 17.01.2022. Hence, the anticipatory bail application of the accused-petitioner may be granted.

On the other hand, learned Public Prosecutor has opposed the bail application.

material available on record.

As per injury reports of injured-Manju Devi and Garima

¶17

Singh, no fresh visible injury has been found on their body and as per injury reports of Hitanshi and Dinesh, they received simple injuries, caused by blunt weapon. Therefore, looking to the above facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioner; but without expressing any opinion on the merits and demerits of the case, I deem it just and proper to enlarge the petitioner on anticipatory bail.

Accordingly, this anticipatory bail application is allowed and it is ordered that in case of arrest of the accused-petitioner in FIR No. 713/2021 registered at Police Station Udyog Nagar Sikar, District Sikar by the Investigation Officer, the accused-petitioner shall be released on bail; provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs. 25,000/- each to the satisfaction of concerned SHO/IO on the following conditions:

i) That the petitioner will make himself available for the investigation as and when required by the investigation officer.

ii) That the petitioner will not leave India without permission of the Court.

iii) That the petitioner will not temper with the evidence or threaten or pressurize the witnesses in the case.
