This bail application has been filed under Section 439 of Cr.P.C. in connection with FIR No. 498/2021 registered at Police Station Chirawa, District Jhunjhunu for the offences under Sections 143, 323, 325, 365, 367 & 382 of IPC.

It is submitted by learned counsel for the petitioners that no specific role has been assigned to the petitioners. The petitioners are behind the bars since long and charge-sheet has been filed. As per rejection bail order, the petitioners No. 1 & 3 have criminal

antecedents of one case each and they are on bail in pending case. The bail application of co-accused Rakesh @ Raka and Sandeep Kumar @ Dagla under Section 439 of CrPC has already been granted by this Court vide order dated 20.04.2022. Hence, the accused-petitioners may be released on bail.

Learned Public Prosecutor and learned counsel for the complainant both have opposed the bail application.

Heard and perused the material available on record.

Considering the submissions made by learned counsel for the petitioners and taking into consideration overall facts and circumstances of the case but without expressing any opinion on the merits/demerits of the case, this court deems it just and proper to enlarge the petitioners on bail.

Accordingly, the bail application under Section 439 of Cr.P.C. is allowed and it is ordered that the accused-petitioners Dinesh Kumar Jhajharia @ Dj S/o Harphool Jhajharia, Hemant Man @ Man S/o Rajesh Man and Saurabh Dangi @ Babloo Shooter S/o Daya Ram Dangi shall be enlarged on bail; provided each of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
