This bail application has been filed under Section 439 Cr.P.C. in connection with FIR No. 225/2019 registered at Police Station Shrimadhopur, District Sikar for the offences under Sections 420, 406, 408, 467, 468 and 471 of IPC.

Learned counsel for the petitioner submits that the petitioner is behind the bars since 27.01.2022 and the offences are triable by the First-Class Magistrate. As per rejection bail order, the petitioner has no criminal antecedents and after investigation, charge-sheet has been filed. Looking to the facts and circumstances of the case, bail application of the petitioner may be granted.

Learned Public Prosecutor as well as learned counsel for the complainant has strongly opposed the bail application.

Considering the submissions made by learned counsel for the petitioner and taking into consideration overall facts and circumstances of the case; but without expressing any opinion on the merits/demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Samadarlal S/o Jaisaram shall be enlarged on bail; provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each (out of which one surety shall be resident of Sikar District) to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
