Learned counsel for the appellants submits that the appeals have been rendered infructuous as the suit itself has been dismissed.
Learned counsel for the respondents submits that the suit has been dismissed in default and in the event of the suit being restored, the present appeals would not be treated as infructuous and may be allowed to be restored.
