Learned counsel for the petitioners argued that there are four injured persons i.e. Manoj Devi, Brijlal, Rajesh and Madanlal. Learned counsel submitted that the injuries sustained by Manoj Devi are on her right ankle and further injury sustained by the injured Brijlal is a fracture on the left parietal bone, however the same injury is not dangerous to life. submitted that there is ongoing family dispute between the parties and cross FIR No.77/2020 under Section 354 IPC was also registered against the complainant party. Learned counsel submitted that the petitioners are in custody since 07.03.2020 and they are not required for any purpose by the Police.

Learned Public Prosecutor has opposed the bail applications. Considering the nature of injuries, period of custody and the pending disputes between the parties, without expressing any opinion on the merits of the case, this Court deems it just and proper to release the petitioners on bail.

Accordingly, the present bail applications under Section 439 Cr.P.C. are allowed and it is ordered that the accused-petitioners Rakesh S/o Mangturam and Manisha Devi W/o Ramesh Kumar in connection with FIR No.61/2020, registered at Police Station Shajahanpur shall be released on bail provided each of them furnishes a personal bond in the sum of Rs.25,000/- with one surety of alike amount to the satisfaction of the learned trial Judge for their appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
