Learned counsel for the petitioner submitted that the petitioner has been implicated for the offences under Sections 8/21 and 8/22 of NDPS Act.

Learned counsel submitted that the petitioner in fact was selling only cough syrup in his private clinic and the contraband substance was lesser than the commercial quantity i.e. 1 Kg. Learned counsel further submitted that the petitioner has no antecedents relating to any such kind of offence for which he has been implicated in the present case. Learned counsel further submitted that in fact the petitioner was falsely implicated by some persons who were having animosity against the petitioner due to professional rivalry.

Learned Public Prosecutor has opposed the bail application.

This Court considering the quantity of contraband recovered from the petitioner and further the nature of allegation levelled against the petitioner and without expressing any opinion on the merits of the case, this Court deems it just and proper to release the petitioner on bail.

Accordingly, the present bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Manish Meena S/o Shri Ramdhan Meena, shall be released on bail in connection with FIR No.54/2020, registered at Police Station Bagru, Jaipur West, District Jaipur, provided he furnishes a personal bond in the sum of Rs.25,000/- with one surety of alike amount to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
