These Criminal Misc. Bail Applications have been brought under Section 439 of Cr.P.C., seeking regular bail in connection with F.I.R. No. 448/2019 registered at Police Station Chandwaji District Jaipur for offence under Sections 419, 420, 395, 365 and 120-B IPC.

Heard learned counsel for the accused petitioner through video conference and perused the record.

It is contended by the petitioners that they have been falsely implicated in these cases. There is no evidence on record to connect them with the crime. No recovery has been made from them. They are in custody since November-December, 2019. Similarly placed co-accused have been enlarged on bail by the Coordinate Bench of this Court. Charge-sheet has been filed. Trial of the case will take time.

Learned Public Prosecutor has opposed the bail application.

I have considered the contentions.

On consideration of arguments/submissions of both the parties, perusal of material on record and particularly to the fact that co-accused Prakash, Kamlesh @ Kalu, Hansraj and Babu Lal have been released on bail by the Co-ordinate Bench of this court, this court deems it fit to enlarge the accused on bail.

Therefore, the bail applications are allowed. Accusedpetitioners (1) Rahul S/o Sh. Puran Meena (2) Aryan @ Vikram Singh @ Hedan S/o Ramlal and (3) Harsahay Meena @ Harsh Meena S/o Shri Ram Gopal Meena shall be released on bail in FIR No. 448/2019 registered at Chandwaji

District Jaipur , if they are not wanted in any other case, provided each of them furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the learned trial court with the stipulation that they shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
