This Criminal Misc. Bail Application has been brought under Section 439 of Cr.P.C., seeking regular bail in connection with F.I.R. No. 17/2020 registered at Police Station Sadar Badi, Dholpur for offence under Sections 379 IPC and Section 29/51 of Wild Protection Act and Section 41 and 42 of Rajasthan Forest Act.

Heard learned counsel for the accused petitioner through video conference and perused the record.

Factual report has been submitted by learned Public Prosecutor. It has been argued on behalf of accused-petitioner that the name of accused-petitioner does not find place in the FIR. No identification parade has been conducted during investigation. There is no previous case against the accused-petitioner. Chargesheet has already been filed in the Trial Court and completion of trial will take time, hence he may be released on bail.

Learned Public Prosecutor has opposed the bail application. Charge-sheet has been filed in this case under Sections 379 IPC and Section 29/51 of Wild Protection Act and Section 41 and 42 of Rajasthan Forest Act.

I have considered the contentions.

On consideration of arguments/submissions of both the parties, perusal of material on record and looking to the facts and circumstances of the case, but without commenting upon detailed merits of the case, this court deems it fit to enlarge the accused on bail.

Therefore, the bail application is allowed. Accused-petitioner Rambhajan S/o Shri Rambharosi shall be released on bail in FIR No. 17/2020 registered at Police Station Sadar Badi, Dholpur , if he is not wanted in any other case, provided he furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
