This Criminal Misc. Bail Application has been brought under Section 439 of Cr.P.C., seeking regular bail in connection with F.I.R. No. 58/2019 registered with Police Station Kotwali Sikar, for the offence/s punishable under Section/s 419, 420, 467, 468, 471, 120B of IPC.

Heard learned counsel for the accused petitioner through video conferencing and perused the record.

It has been argued on behalf of the accused petitioner that the investigation has been completed and after throrough investigation, charge-sheet has been filed in learned trial court, trial of the case will take time, co-accused Sohan Lal and Kailash Chand Tiwari have already been released on bail by coordinate bench of this court. Kumar, the amount was handed over to co-accused Kailash Chand Tiwari, who has already been released on bail. Accused petitioner is a senior citizen.

Learned Public Prosecutor has opposed the bail application.

On consideration of arguments/submissions of both the parties, perusal of material on record and looking to the facts and circumstances of the case particularly that co-accused persons have already been released on bail by coordinate bench of this court, this court deems it fit to enlarge the accused petitioner on bail.

Therefore, the bail application is allowed. Accused petitioner Anwar Qazi S/o Shri Fateh Mohammad be released on bail in FIR No. 58/2019 registered with Police Station Kotwali Sikar, if he is not wanted in any other case, provided he furnishes a personal bond in the sum of ₹ 1,00,000/- (one lakh) together with two sureties in the sum of ₹ 50,000/- (fifty thousand) each to the satisfaction of learned trial court with the stipulation that he shall appear before that court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
