Taking note of the fact that the stand of the RPSC in regard to recruitment of Rajasthan State and Subordinate Services, 2013 and 2016 and the interim order passed by the Supreme Court in the aforesaid matters, in our view, the order passed by the learned Single Judge permitting all reserved category candidates, who without taking benefit of any concession, except on payment of fees, are more meritorious than the last of the open category candidate in the RAS Preliminary Examination 2018, to participate in the main examination, subject to outcome of the writ petitions, was in the circumstances of the case, perfectly just and reasonable order, particularly when the learned Single Judge has also directed that the result of the Main Examination, 2018 for RAS and Allied Services to be held on 23.12.2018 onwards, shall not be declared till further directions/permission of this Court. We, however, make it clear that if in the meantime, the controversy is finally resolved by the Supreme Court in Garima Sharma, supra, or otherwise if the process of Mains Examination, 2018, supra, is completed, it would be open for State Government / RPSC to make appropriate application for further directions in the writ petition before this Court.
