Learned counsel for the petitioner submits that the petitioner is behind the Bars for last two years.
Learned Public Prosecutor as well as learned counsel for the complainant have opposed the contentions of the learned counsel for the petitioner and submit that out of 23 listed witnesses, 20 witnesses have already been examined. Trial is at the fag end.
In view of above, I am not inclined to enlarge the petitioner on bail.
Accordingly, the present 3rd bail application filed by the petitioner under Section 439 Cr.P.C. is dismissed. However, it is expected from the learned trial Court that the learned trial Court shall expedite the trial proceedings and complete the same at the earliest.
