Learned counsel for the petitioner has submitted that after rejection of bail application of the petitioner by the trial court, statements of several prosecution witnesses have been recorded before the trial court, therefore, he does not want to press this bail application at this stage, however, seeks liberty for the petitioner to file fresh bail application before the trial court.
Accordingly, this criminal misc. bail application preferred by the petitioner under Section 439 Cr.P.C. is dismissed as not pressed with the liberty sought for.
