Heard learned counsel for the petitioners as well as learned Public Prosecutor and also perused the material on record.

The petitioners have been arrested in connection with FIR No.61/2019 of Police Station City Kotwali, District Bhilwara for the offence punishable under Section 395 I.P.C. They have preferred these bail applications under Section 439 Cr.P.C.

Learned counsel for the petitioners has submitted that charge-sheet has been filed and the petitioners are in custody since January 2019 and trial of the case will take time.

Per contra, learned Public Prosecutor has opposed the bail application and submitted that all the petitioners are citizens of Nepal and there are all possibilities that if they are released on bail, they may abscond. Learned Public Prosecutor has, therefore, submitted that the petitioners may not be enlarged on bail.

Having regard to the totality of the facts and circumstances of the case and having gone through the case diary, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the accused petitioners under Section 439 Cr.P.C.

Accordingly, these bail applications filed under Sec.439 Cr.P.C. are allowed and it is directed that petitioners Pawan @ Pankh @ Pankaj S/o Jai Bahadur Shahi (Thakur), Ratan S/o Shankar Shah and Padam S/o Lachhi Shah shall be released on bail in connection with FIR No.61/2019 of Police Station City Kotwali, District Bhilwara provided each of them executes a personal bond in a sum of Rs.5,00,000/- with two sound and local solvent sureties of Rs.2,50,000/- each to the

satisfaction of learned trial court for his/her appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
