The present contempt petition has been filed alleging noncompliance of the order dated 05.03.2018, passed by this Court whereby the respondents were directed to consider petitioners’ representation and also permit them to participate in the counseling.

Mr. Ojha, learned counsel appearing for the respondents submits that the petitioners’ cases have been considered and their candidatures have been rejected vide order dated 13.07.2018. As such the requisite compliance, of-course with some delay, has been made.

Mr. Verma, learned counsel appearing for the petitioners submits that the directions of this Court were two fold and the respondents were directed to permit the petitioners to participate in the counseling apart from considering their candidature. He apprehended that if the writ petition already filed by the petitioners against the order dated 13.07.2018 is allowed, the

respondents would not permit the petitioners under the pretext that they have not participated in the counseling.

In considered opinion of this Court, the apprehension of Mr. Verma, learned counsel for the petitioners is misplaced inasmuch as the respondents having themselves failed to permit the petitioners to participate in process of counseling cannot non-suit the petitioners on the pretext of not having taken part in the counseling.

Having heard learned counsel appearing for the parties and upon perusal of the order dated 13.07.2018 and unconditional apology tendered by the respondents – contemnors for delay in complying with the order, this Court is not inclined to proceed with the present contempt petition, for which the notices of contempt are hereby discharged.

The contempt petition stands disposed of for statistical purposes.
