While writing his examination for final year of Diploma course in Electrical Engineering at examination center ITI Govt. College, near Chinkara Canteen Jaipur; the petitioner was allegedly found using unfair means, resulting into withholding of his result; is the cause for institution of instant writ application with a prayer for a direction to the respondents to declare his result.

Learned counsel for the petitioner referring to an undated explanation furnished as to the allegations of use of ‘unfair means’

vide Annexure-4, asserted that despite of the detailed explanation furnished, no decision has been taken by respondents so also result of the petitioner has been withheld.

Having considered the statements put-forth and materials available on record. For the present, the petitioner is directed to address a comprehensive representation to the respondents enclosing a copy of the detailed undated explanation placed on record as Annexure-4, within two weeks hereinafter.

In case, a representation is so addressed within the aforesaid period, the respondents are directed to consider and decide the same by a reasoned and speaking order as expeditiously as possible; preferably, within six weeks from the date of receipt of the representation along with a certified copy of this order, in accordance with law.

Reasons declining claim of the petitioner should be communicated to the petitioner through registered post.

In case, petitioner is still aggrieved, he would be at liberty to avail of remedy in accordance with law.

With the observations and directions, as indicated above, the writ proceedings stand closed.
