After arguing for some time, learned counsel for the petitioner seeks permission of this Court to withdraw the present writ petition with a liberty to apply for modification of the issues in light of notifications dated 01.10.2008 and 20.05.2009.
Permission is granted. Petition is dismissed as withdrawn with liberty prayed for.
Needless to observe that as and when such application is moved by the petitioner-defendant, the trial Court shall decide the same strictly in accordance with law.
