According to counsel for the petitioner, despite controversy raised in the instant writ application has already been adjudicated upon by a Division Bench of this Court in the case of State of Rajasthan & Anr. v. The Management Committee, Sh. Bhagwan Das Todi College, vide order dated 06.11.2015; yet, claim of the petitioner has not been declined by the State-respondents.

Counsel further urged that for the present, the petitioner would be satisfied, if the State-respondents are directed to consider and decide the representation within a time frame, in the backdrop of the law declared in the case of The Management Committee, Sh. Bhagwan Das Todi College (supra), which the petitioner is ready and willing to address within two weeks hereinafter.

In view of the limited prayer addressed; the instant writ proceedings are closed with a direction to the petitioner to address a comprehensive representation to the respondents ventilating grievances raised in the writ application.

In case, a representation is so addressed within the aforesaid period, the State-respondents are directed to consider and decide the same by a reasoned and speaking order as expeditiously as possible in accordance with law. However, in no case later than three weeks from the date of receipt of the representation along with a certified copy of this order.

It is further directed that while determining the representation of the petitioner, the respondents shall record reasons for declining the case of the petitioner and communicate the same to the petitioner.

In case, the petitioner is still aggrieved of the decision of the respondents on his representation, he would be at liberty to avail of the legal remedy in accordance with law.

With the observations and directions, as indicated above, the writ application stands disposed off.
