Shri C.P. Sharma, learned counsel for the respondents submitted that petitioner entered into a compromise with the respondent before the Lok Adalat on 8.3.2015 whereby it was agreed that petitioner shall pay total sum of Rs.2,25,000 to the respondent no.3-UCO Bank within two months. Since he has deposited the amount of Rs.50,000, the due amount still remains against the petitioner was Rs.1,56,067.23 as on 1.4.2016 and if the amount of interest is added thereto for the subsequent period, this amount would further enhance. It is contended that this was not the amount of loan but C.C. limit was provided to the petitioner in his account and, therefore, it cannot be allowed to be paid in installments. Therefore, petitioner has to make payment of entire amount at one go.
