Petitioner has filed this petition under Section 439 Code of Criminal Procedure Code 1973 for seeking regular bail in F.I.R. No. 87/2016 registered at P.S. Kamkhera, Distt. Jhalawar, for the offences u/sec. 143, 341, 323, 324, 325 & 308 of Indian Penal Code, 1860.
Learned counsel for the petitioner has submitted that as per the prosecution story petitioner had given a sword blow of the left cheek of injured Usuf Khan. However, as per the injury report, the said injury had been caused by a blunt weapon. Petitioner is in custody since 22/11/2016.
Learned state counsel on the other hand has opposed the petition.
Keeping in view the facts and circumstances of the case, it would be just and expedient to order the release of the petitioner on
bail.
Accordingly, without expressing any opinion on the merits of the case, this petition is allowed. Petitioner be admitted to bail subject to satisfaction of the Trial Court.
