Mr. Suresh Sharma, for the petitioner. Mr. N.M. Lodha, Advocate General with Mr. Anirudh Mathur, for the respondent.
Learned Advocate General submits that the order dated 31-32016, which has been impugned in this writ petition has been superseded by order dated 12-5-2016 whereby by resort to the power under clause 19 of the Code of Criminal Procedure and Law and Legal Affairs Department Manual, 1999 and in the resultant discretion of the State Government, the petitioner's appointment as a public prosecutor has not been extended beyond 29-2-2016 and he has consequently discontinued simplicitor from the post of Public Prosecutor. In the circumstances, the writ petition has been rendered infructuous, it was submitted.
Counsel for the petitioner is not in a position to controvert the fact stated and submissions of the learned Advocate General.
In the circumstances, the writ petition stands dismissed as infructuous.
