been declared hostile. The recovery of knife cannot be relied in view of statement of the witnesses who had admitted that no independent witness was called other than the police officials. In view of aforesaid, petitioner may be granted bail.

Learned Public Prosecutor has opposed the bail

application. He submits that two eye witnesses are yet to be examined and otherwise recovery of knife has been made. It has been used for causing offence under section 302 IPC. The FSL report is relevant and it is not necessary that one would be acquitted only if witnesses have been declared hostile, rather, statement of the witnesses may

also be considered to the extent it is corroborated by other witnesses. In view of above, petitioner may not be enlarged on bail.

After considering rival submissions of the parties and without expressing any opinion on merits of the case, which may otherwise affect outcome of the trial but looking to the facts of this case, I am not inclined to grant bail to the petitioner. Hence, bail application is dismissed.
