On the joint request made by the counsel for the parties, hearing of the present contempt petition is preponed from 25/05/2016 to today and the contempt petition is taken on the board.
In the instant contempt petition preferred under Section 12 of the Contempt of Courts Act, 1971, read with Article 215 of the Constitution of India, a grievance has been made by the petitioner that the order dated 22/09/2011 passed by the learned Single Judge in S.B. Civil Writ petition No.13256/2012 has not been complied with.
The learned counsel appearing for the petitioners has very fairly submitted that in compliance of the order dated 22/09/2011, the respondents have decided representation of the petitioner. However, learned counsel submitted that the reasons given in the order rejecting

representation of the petitioner are palpably wrong and same are not legally tenable. Thus, learned counsel submitted that he may be permitted to withdraw the present contempt petition with liberty to assail the order passed by the respondents on the representation filed by the petitioner by availing lawful remedy in accordance with the provisions of law.
As prayed, the present contempt petition is, hereby, dismissed as withdrawn with liberty aforesaid.
