Although, the accused-petitioner has filed this Criminal Misc. Petition under Section 482 Cr.P.C. for quashing of the FIR, but during the course of hearing of this petition, it was submitted on behalf of the petitioner that the respondent investigating agency be directed to undertake fair and impartial investigation after taking into consideration the documents submitted on behalf of the petitioner. It was further submitted that even if after investigation final report under Section 173 (2) Cr.P.C. has been prepared even then the documents filed on behalf of the petitioner can be considered and fresh final report can be prepared by the investigating agency.
In view of the above, the investigating agency is directed to take into consideration the documents filed on behalf of the petitioner and only thereafter the final report may be prepared and filed before the Court concerned.
The criminal misc.petition stands disposed of. The stay application also stands dismissed.
