ाथर् ने यह ्ऺाथर्नाप्ऴ धारा 439 द� ड ्ऺि्वया संिहता के तहत ्ऺ� तुत कर जमानत पर � वतं्ऴ िकये जाने की ्ऺाथर्ना की है। ्ऺ
ाथर् के िव्षान अिधवक् ता का तकर् है िक ्ऺ ाथर् की िवचारण �यायालय के सम्ष अनुपि�थित जान-बूझकर नहीं थी। ्ऺ ाथर् अनपढ़ है, िजसे िह�दी भाषा का ्ञ ान नहीं है और वह मजदूरी हेतु बाहर चला गया था, अपने अिधव्व ा से स�पकर् नहीं कर पाया। वह ल�बे समय से �याियक अिभर्षा म� है, िवचारण म� समय लगेगा। अत: ्ऺाथर् को जमानत पर आजाद िकया जावे।
िव्षान लोक अिभयोजक ने इसका िवरोध िकया।
करण के उभयप्ष के िव्षान अिधवक् तागण को सुनने एवं इस ्ऺ करण के त� य� व पिरि� थितय� का अवलोकन करने के उपरा� त म� ्ऺ गुणावगुण पर कोई राय � यक् त िकये िबना ्ऺ ाथर् को जमानत पर िरहा करना उपयुक् त समझता हूं।
अत: आदेश िदया जाता है िक यिद ्ऺ ाथर् झ�टू पु्ऴ युिधि�र �पये 11,000/- धारा 446 द�ड ्ऺ ि्वया संिहता के तहत जुमार्ना रािश िवचारण �यायालय म� जमा करावे तथा 2,00,000/- (अ्षरे दो लाख �पये) का � वयं का बंधप्ऴ एवं एक-एक लाख �पये की रािश की दो ्ऺ ितभूित िवचारण � यायालय की संतुि� ट पर पेश कर त� दीक करावे िक वह िवचारण के दौरान िवचारण � यायालय के सम्ष उपि� थत होता रहेगा तो ्ऺथम सूचना िरपोटर् संख् या 56/2003 पुिलस थाना संजय सिकर्ल जयपुर से संबंिधत फौजदारी्ऺ करण म� उसे जमानत पर िरहा कर िदया जावे।
