Heard learned counsel for the accused-applicant as well as the learned Public Prosecutor and perused the record of the case.

It is stated that after dismissal of first bail application, charge sheet in the case has been filed. The specific allegation does not exist against the accused-applicant, thus he may be enlarged on bail. He undertakes not to commit same or other offence during the period of bail, on its grant.

Learned Public Prosecutor has opposed this bail

application.

After considering all the facts and circumstances of the case and without expressing any opinion on merits of the case, which may otherwise affect outcome of the trial but looking to the facts available on record, I am of the view that accused-applicant deserves to be enlarged on bail.

Accordingly, this second bail application under Section 439 Cr.P.C. is allowed. It is ordered that accused-applicant, namely, Rakesh Jhajharia be released on bail in FIR No.73/2015 registered at Police Station Sadar, Jhujhunu for offence under Sections 341, 323, 427/379, 308, 458, 459 & 460 IPC provided, he furnishes a personal bond in the sum of Rs.50,000/- together with one surety in the like amount to the satisfaction of the

learned trial Court for his appearance before that Court on all subsequent dates of hearing and as and when called upon to do so. It is made clear that if the accused-applicant is found committing same or other offence during the period of bail, the Prosecution would be at liberty to seek cancellation of this bail order.
