It is stated that even after supply of material as per agreement, the impugned orders adverse to the petitioner were passed. The court may examine as to whether material was supplied by the petitioner or not and in the alternative, a direction be given to the respondents to consider and decide the representation within time frame.

I have considered the submission made by the petitioner and find that writ petition was dismissed considering all the relevant facts. Whether material was supplied or not as per agreement is a question of fact and cannot be determined by this court in writ jurisdiction. The petition was dismissed with liberty to the petitioner to make a representation or to take alternative remedy as is available to him. The petitioner has already made representation in pursuant to the liberty given by this court, thus review of the order is not made out. It is moreso when it involves question of fact. However, review petition is disposed of with the direction to the respondents to consider and decide the representation submitted by the petitioner within time frame and if possible within a period of two months from the date of receipt of copy of this order.
