ा ने इस �यायालय का �यान इसके िवपरीत िवप्षी के िव्षान अिधव्व साद बनाम िविध ��ा�त ए.आई.आर. 2004 सु्ऺीम कोटर् 4674 अदालत ्ऺ �पलाल िजंदल व अ�य की ओर आकिषर्त िकया।

इस ्ऺ करण के त�य� म� जाने से पूवर् यह �यायालय सेशन �यायाधीश, धौलपुर ्षारा पािरत आदेश िदनांक 18.9.2008 को अपा�त करते हुए उ�ह� पुन: दोन� प्ष� को सुनकर िविध अनुसार आदेश पािरत िकये जाने का आदेश िदया जाना �यायसंगत समझती है।
अत: सेशन �यायाधीश, धौलपुर ्षारा पािरत आदेश िदनांक 18.9.2008 �यायालय को िनद�श िदया जाता है िक वे को अपा�त करते हुए उ्व प्षकार� को पुन: सुनवाई का अवसर देते हुए उनके ्षारा इस �यायालय के सम्ष ्ऺ �तुत िकये गये उपरो्व विणर्त िविध ��ा�त� एवं उनके सम्ष्ऺ �तुत िकये जाने वाले िविध ��ा�त� पर गौर करते हुए िविध अनुसार अपना आदेश पुन: पािरत कर�। प्षकारान सेशन �यायाधीश, धौलपुर के सम्ष िदनांक 19.2.2014 को उपि�थत ह�। ्ऺ
