र९ाथ�-पिरवादी िकन्दूरीलाल की ओर से उपरो्व विणत दांिडक िविवध यािचका संख्या 1366/2013 र९स्तुत कर पुिलस थाना म�हदीपुर बालाजी िजला दौसा पर पंजीब� र९थम सूचना िरपोटर् संख्या 10/2011 के मामले म� िनष्प्ष अनुसंधान कराये जाने की र९ाथर्ना की गयी है एवं र९ाथ�-अिभयु्व हरीिसह की ओर से उपरो्व विणत दािण्डक िविवध यािचका संख्या 438/2013 र९स्तुत उ्व उपरो्व विणत र९थम सूचना िरपोटर् संख्या 10/2011 को अपास्त िकये जाने की र९ाथर्ना की गयी है। चूंिक उपरो्व विणत दोन� यािचका� के अन्तगर्त एक ही र९थम सूचना िरपोटर् के मामले म� अनुतोष चाहे गये ह�, िजससे इनका िनस्तारण इस एक ही आदेश के �ारा िकया जा रहा है।

मैन� उभयप्ष के िव�ान अिधव्व ागण को सुना। पर७ावली पर उपलब्ध सामरय़ी का ध्यानपूवर्क अनुशीलन िकया। न्यायिहत म� उपरो्व विणत र९थम सूचना िरपोटर् के मामले म� दोन� ही

यािचका� के र९ाथ�गण को अनुसंधान अिधकारी के सम्ष अभ्यावेदन व दस्तावेजात र९स्तुत करने की स्वतंर७ता र९दान करते हुए अनुसंधान अिधकारी को िनद�श िदया जाता है िक वे ऐसे अभ्यावेदन व दस्तावेज� के तथ्य� पर भी अनुसंधान करते हुए मामले म� िनष्प्ष अनुसंधान कर�।

उपरो्व विणत दोन� दािण्डक िविवध यािचका� का िनस्तारण उपरो्व ानुसार िकया जाता है। यािचका संख्या 438/2013 के साथ संल्ि स्थगन र९ाथर्नापर७ िनरस्त िकया जाता है।
