This petition has been filed under Section 482 CrPC with the following prayer:

“It is, therefore, humbly and respectfully prayed that the criminal misc. petition filed by the accused petitioner may kindly be accepted and allowed and the Hon'ble Court may kindly be pleased to quash & set-aside the First Information Report 213/2009 registered at Police Station Vidhyut Thana (APT), Alwar (Rajasthan) for the offence under Section 135, 136 & 150 of Electricity Act 2003 against the petitioner.”

Learned counsel for the petitioner wants that this petition should be disposed of with the following directions:

i) The Investigating Officer should be directed to investigate the matter fairly, properly and impartially.

¶9

ii) If the petitioner submits any representation/documents before the I.O., then the contents of the same should also be investigated by him.

¶10

Iii) The Investigating Officer should also be directed that if he wants to file challan, he will give prior intimation to the petitioner.

¶11

Although learned PP appearing for the State has opposed the same.

¶12

The prayer of the counsel for the petitioner seems to be

genuine, hence ordered accordingly.

¶14

The Cr. Misc. Petition as also the stay application, both stand disposed of with the aforesaid direction.

¶15

However, the petitioner is given liberty to file a fresh petition under Section 482 CrPC, if he feels to do so.
