Learned counsel for the applicant-petitioner has submitted that the main case is listed for 03.09.2026 but during the pendency of the present writ petition, the National Company Law Tribunal, New Delhi vide order dated 30.07.2025 passed in CP(IB) No.404(PB)/2024 has admitted the petition under Section 7 of the Insolvency and Bankruptcy Code, 2016 filed by the IDBI Bank Limited against the applicant-petitioner and has imposed moratorium under Section 14 of the IBC, 2016.

Learned counsel for the petitioner has very fairly submitted that

in the present case, even the IRP has been appointed and thus, the petitioner through its director is not entitled to pursue the present petition. It is submitted that the main case be preponed and the present petition be disposed of and liberty be granted to IRP to pursue the case in case he chooses to do so.

Keeping in view the above said facts and circumstances, the CM is allowed and the main case is preponed from 03.09.2026 to today and the present petition is disposed of with liberty to the petitioner to revive the case in case IRP wishes to pursue the same in accordance with law.
