Rakesh Kumar Garg Vs State of Haryana and Ors.

(i) Issue a Writ in the nature of Mandamus , or any other appropriate writ, order, or direction, directing the Respondents to forthwith allot a residential plot of 200 sq. mtrs. to the Petitioner in the developed Industrial Estate, Barwala, Phase-II, Panchkula, in terms of the Certificate of Entitlement dated 16.08.2016 (Annexure P-2) and for which the petitioner has already deposited 10% of the tentative price in December 2020;

(ii) Direct the Respondents to complete the process of allotment and issue the Letter of Intent/Allotment Letter to the Petitioner in a time-bound manner,

(in) Call for complete record pertaining to the matter in hand;

(iv) Award appropriate cost/compensation to the petitioner in terms of interest on the amount deposited;

(v) Exempt the petitioner from filing certified/true copies of

Learned counsel for the petitioner has submitted that the petitioner was the owner of land measuring 3 kanals 1 marla comprised in Khasra No.14//8, 9/1, 13/2 situated in the revenue estate of Barwala, District Panchkula, Haryana. It is submitted that the land of the petitioner was acquired by HSIIDC in the year 2011 and as per the Rehabilitation and Resettlement Policy of the Government of Haryana dated 09.11.2010, the petitioner became entitled to the allotment of a residential plot and the HSIIDC issued a certificate of entitlement to the petitioner on 16.08.2016 with respect to the petitioner being entitled to a residential plot measuring 200 square metres in Industrial Estate, Barwala. It is submitted that subsequently the demand was also raised from the petitioner of 1,95,680 which was deposited by the petitioner on₹ 01.12.2020. It is further submitted that the petitioner has done what was required to be done but till date no plot has been allotted to the petitioner and for the redressal of his grievance, the petitioner served a legal notice dated 01.06.2026 (Annexure P-8) to respondents No.2 and 3 and at this stage, the petitioner would be satisfied in case respondent No.3 is directed to decide the same in a time bound manner.

Learned counsel for the respondents has submitted that the said legal notice dated 01.06.2026 would be considered and decided by respondent No.3 within a period of three months from today after hearing the petitioner or his representatives and in case the pleas of the petitioner are found to be meritorious, then, necessary relief would also be granted to the petitioner.

Keeping in view the abovesaid facts and circumstances, the present writ petition is disposed of with direction to respondent No.3 to consider and decide legal notice dated 01.06.2026 by passing a speaking order within a period of three months from today. In case, respondent No.3 finds that the pleas raised by the petitioner are meritorious, then, necessary relief would also be granted to the petitioner expeditiously.
