The present petition has been filed by the petitioner under Articles 226/227 of the Constitution of India, seeking a writ of mandamus, directing the respondents to grant the technical pay scale to the petitioner from the year 2013 when he has passed the competency test in Module Basic Electrical Training (Annexure P-2).

Learned counsel for the petitioner submits that the petitioner joined the services as a Pump Operator on 12.02.1989 with respondent No.2-Municipal Committee, Nangal, Water Supply Branch and, thereafter, the petitioner sought permission from respondent No.2 for doing part time ITI in the trade of Electrician and the said request was accepted and NOC dated 30.05.2013 (Annexure P-1) was issued. Thereafter, the petitioner did his part time ITI in Electrician Trade and

in this regard certificate dated 09.10.2013 (Annexure P-2) was also issued to the petitioner by the National Council for Vocational Training, Ministry of Labour and Employment, Government of India. Thereafter, the petitioner submitted a representation dated 12.03.2021 (Annexure P-3) to respondent No.2 for grant of technical pay scale from the year 2013, however, the petitioner has not been granted the same. Hence, the present petition.

Pursuant to the notice of motion order dated 01.09.2021, short reply by way of affidavit of Rakesh Kumar, Joint Secretary to Department of Local Government, Punjab, on behalf of respondent No.1 has been filed, wherein it has been stated that the petitioner has only completed three months course from ITI, Nangal. Hence, he is not entitled for the technical pay scale as only those persons, who have acquired two years ITI certificate, are eligible for the grant of technical pay scale. Separate written statement on behalf of respondent No.2 has also been filed, wherein also, the same stand has been taken.

I have heard learned counsel for the parties and perused the record.

Since the petitioner does not have the required ITI certificate of two years, therefore, he is not entitled for the grant of technical pay scale. Consequently, the present petition being devoid of merit, is hereby dismissed.
