Petitioner seeks anticipatory b a il in case arising out of FIR No.137 dated 01.10.2025, under Sectio n s 118(4), 319(2), 308(2), 115(2), 61( 2 ) of BNS, Police Station Kh u i Khera, Tehsil Abohar, District Fazi l ka, Punjab. This is the first peti t ion for anticipatory bail.

W h ile issuing notice of motion o n 25.05.2026, following order was passed:-

“Prayer in the present p e tition filed under Section 482 of the BNSS, 2023 is for gr ant of anticipatory bail to the petitioners in case FIR N o.137 dated 01.10.2025 registered under Sections 118( 4) , 319(2), 308(2), 115(2), 61(2) of BNS, 2023 at Police S t ation Khuhi Khera, Tehsil Abohar, District Fazilka.

Learned counsel for the p etitioner contends that the p etitioner has been falsely imp li cated in the present case.

He further contends that th e petitioner has been nominated as an accused o n ly on the basis of the disclosure statement made by c o -accused. Apart from the disclosure statement, there i s no other evidence to connect the petitioner with the o ffence in question and it is a trite law that disclosure st a tement of the co-accused during his/her custodial interro g ation is not admissible in evidence He further submits t h at the present FIR is an outcome of a grudge betwee n the petitioner and the complainant as there was a m onetary dispute between both of them. He further subm it s that co-accused persons have already been granted c o ncession of bail by the learned Trial Court. Learn e d counsel has further submitted that the petitioner is ready and willing to join the investigation as and when ca lled upon to do so by the investigating agency.

On the other hand, lear ne d State counsel has filed the status report which is ta ke n on record. She while referring to the same, has oppo se d the prayer for grant of anticipatory bail, by submitting th at the allegations levelled against the petitioner are serious i n nature.

In the meantime, the pe t itioner is directed to join investigation within a week fro m today and would appear as and when required by the I nvestigating Officer and cooperate with the Investigatin g Agency. In the event of arrest, he shall be admitted to i nterim bail on furnishing of bail/surety bonds to the satisfaction of Arresting/Investigating Officer. The petitioner shall also
