Gorav @ Ragubir Singh Vs State of Punjab and Anr.

Petitioner seeks regular bail in case arising out of FIR No.14 date d 12.02.2025 under Sections 3 03(2), 118(1), 109, 324(2), 351(2), 19 1 (3), 190 of BNS, Police Stat i on City Jalalabad, District Fazilka. O f fence under Section 304 of B N S was added and offence under Sect i on 303(2) was deleted during i nvestigation. This is the third petiti o n for regular bail. The first petition was dismissed as withdrawn vide order dated 27.10.2025. The second petition was allowed vi d e order dated 09.03.2026 in CR M -M-72754-2025.

Briefly stated, the FIR was registered on statement of complaina n t Sachin Kamboj, who stated that on 01.02.2025 he had gone to Ja l alabad in connection with so m e domestic work. When he reached ne a r New Bus Stand, two unkn o wn motorcyclists snatched gold chain w eighing about 1.5 tola from h i s neck and fled. Thereafter,

upon inqui r ies he learnt that Harman Sing h and Happy were involved in the said i ncident. He further alleged that o n 04.02.2025, when he was present ne a r Old Tehsil after finishing his work and confronted them regarding t h e snatching of his chain, the said persons along with several other associates including the petitioner G orav @ Raghubir Singh @ Gora and other co-accused arrived armed with weapons such as kirpans, k a ppas and baseball bats. They raised lalkara, abused the complaina n t and attacked him with their re s pective weapons, as a result of which h e fell on the ground and sus t ained injuires. It is further alleged tha t the accused persons also brok e his mobile phone and fled away from the spot on their motorcycles w h en nearby shopkeepers and passersby c ollected. The complainant w a s thereafter taken to Civil Hospital a n d subsequently referred to h igher medical centers for treatment o f the injuries sustained by him.

Learned counsel for the pet i tioner submits that though petitioner w as ordered to be released on r e gular bail by a Co-ordinate Bench on 0 9.03.2026, the police had als o invoked Section 304 BNS which inad v ertently could not be mentione d in the previous petition for bail. Petit i oner thereafter moved applica t ion vide CRM-13214-2026 which was dismissed as withdrawn with liberty to file a fresh petition for regular bail as the offence under Se c tion 304 BNS was already added bef o re passing of order dated 09.03.2026. Learned counsel further su b mits that in view of previo u s order dated 09.03.2026, petitioner deserved to be enlarged on bail i n Section 304 BNS as well.

Mr. Sukhbeer Singh, DAG, Punjab, accepts notice on behalf of r espondent-State. He opposed the prayer for regular bail submitting that in view of the nature of allegations against the petitioner, h e did not deserve to be enlarge d on bail.

Heard. 7. Petitioner has already been a llowed regular bail in FIR No.14 date d 12.02.2025. At the time of p assing the order, the police had added Section 304 BNS in the FIR w hich the petitioner did not, due to ina d vertence mention in his petiti o n. It is not in dispute that Section 30 4 BNS has been invoked on the allegations in the FIR wherein p e titioner has already been g r anted concession of bail. Considerin g entire facts and circumstanc e s of the case, but without commentin g on merits, petitioner is order e d to be released on regular bail subjec t to his furnishing adequate b a il and surety bonds to the satisfaction of trial Court/Duty Magistrate.
