complainant, while being accompanied by some unidentified persons. It is further submitted that complainant is involved in a dispute regarding agricultural land with the petitioner, who has inherited the said property on the basis of a Will.

On the very outset, learned State counsel has filed status report dated 03.02.2026 in the Court today and the same is taken on record. Registry is directed to tag the same at the appropriate place on the file.

As per the allegations contained in the FIR, complainant, Harjinder Singh, is stated to have suffered total three injuries, which have been detailed in the status report, and are reproduced hereunder:-

Further, from the status report, it is evident that injury No.1

has been declared simple in nature; injury No.2 has been declared grievous in nature, as it involves a fracture of the 5^th metacarpal of the right hand; and injury No.3 has also been declared simple in nature.

There are three accused in the present case, namely Mandeep Singh alias Manna (petitioner herein), Kuldeep Singh, and Sandeep Singh alias Chikki.

At this stage, learned counsel for the petitioner submits that although, injuries on the head and arm of the injured have been attributed to the petitioner, yet, keeping in view the nature of injuries as well as total period of incarceration already undergone by him, i.e., for a period of six months and six days, learned counsel prays for grant of the concession of regular bail to the petitioner in the present case.

On the other hand, learned State counsel, while opposing the prayer and submissions made by learned counsel for the petitioner, submits that in view of the gravity of the offence allegedly committed by the petitioner, he is not entitled to the concession of regular bail.

It is further contended that there exists a strong apprehension that, if released on bail, petitioner may misuse the concession by intimidating or influencing the prosecution witnesses, or by tampering with the evidence.

Learned State counsel further submits that petitioner is a habitual offender, as, apart from the present case, he is involved in four other criminal cases. Thus, he prays for dismissal of the present petition.

This Court has heard the submissions advanced by learned counsel for the parties and has carefully perused the record available before it.

above. Injury No.1 has been declared simple in nature; injury No.2 has been declared grievous in nature, as it involves a fracture of the 5^th metacarpal of the right hand; and injury No.3 has also been declared simple in nature.

Although the injuries on the head and arm have been attributed to the petitioner, yet, keeping in view the nature of the injuries, total period of incarceration already undergone by the petitioner, the overall facts and circumstances of the case, and the allegations levelled against him, this Court deems it appropriate to grant the concession of bail to the petitioner in the present case.

Consequently, prayer made in the present petition is allowed . Petitioner is ordered to be released on bail, subject to his furnishing bail/surety bonds to the satisfaction of the learned trial Court/ Chief Judicial Magistrate/ Illaqa Magistrate/ Duty Magistrate concerned, if not required in any other case.

Needless to observe that the petitioner shall not extend any threat and shall not influence any prosecution witness in any manner directly or indirectly.

Therefore, trial Court is expected to decide the case by taking an independent view, on the basis of evidence available on record, as expeditiously as possible, in accordance with law.
