Present petition has been filed by the petitioner, seeking grant of regular bail, in case, FIR No.0099, dated 25.09.2024, under Sections 103(1), 118(1), 3(5), 115(2), 238, 354(3) of BNS, registered at Police Station Tappa Mandi, District Barnala.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. As per the allegations levelled by the prosecution, petitioner is alleged to have caused injuries to the deceased with a kirch and a screwdriver on the stomach.

It is further submitted that during the course of examination, complainant (PW-1), who lodged the present FIR against the petitioner, has not supported the case of prosecution.

Learned counsel further submits that the co-accused, namely Gurdarshan Singh @ Darshan, has already been granted the concession of bail by learned Sessions Court, vide order dated 23.07.2025 (Annexure P-3). Moreover, petitioner is in judicial custody since 25.09.2024, i.e., for a period of approximately one year, four months, and nine days. Thus, counsel prays for grant of regular bail to the petitioner in the present case.

On the other hand, learned State counsel has filed custody certificate dated 03.02.2026 in the Court today and the same is taken on record.

This Court has heard the submissions advanced by learned counsel for the parties and has carefully perused the record available before it.

Undoubtedly, complainant, namely Bania Ram, has not supported the case of the prosecution. However, it is observed that, unfortunately, there is neither any concrete proposal nor any effective statutory mechanism is present in our country to adequately protect and secure the life and liberty of such witnesses.

Co-accused, Gurdarshan Singh @ Darshan, who has been granted the concession of bail, stands on a different footing, as no injury is attributed to him and the allegation against him is limited to instigating the petitioner and other co-accused to teach a lesson to the deceased, Amandeep Singh alias Amna.

Keeping in view the nature and gravity of the allegations, particularly that the deceased, Amandeep Singh alias Amna, was brutally murdered by the petitioner along with other co-accused, this Court does not find it to be a fit case for granting the concession of bail.

Consequently, present petition is dismissed .
