In the present petition, the petitioner is praying for issuance of a writ in the nature of mandamus directing the respondents to re-fix the pay of the petitioner after granting the benefit of annual increments from 2016 onwards. It is also the case of the petitioner that in fact no retiral benefits have been released to the petitioner after his retirement.

Learned counsel for the petitioner submits that a legal notice dated 01.05.2025 (Annexure P-7) has been served upon the respondents, however, no decision has been taken thereupon. He further submits, on instructions from the petitioner, that at this stage, he will be satisfied if a

direction is given to respondent No.3 to decide the legal notice dated 01.05.2025 (Annexure P-7) in a time bound manner.

Mr. Vikas Arora, DAG, Punjab accepts notice on behalf of respondents No.1 and 2 and on the asking of the Court, he accepts notice on behalf of respondent No.3 also and does not object to the prayer made by learned counsel for the petitioner.

In view of the above and without commenting upon the merits of the case, the present petition is hereby disposed of with a direction to respondent No.3 to consider and decide the legal notice dated 01.05.2025 (Annexure P-7), within a period of 03 months from the date of receipt of certified copy of this order, in accordance with law. In case, the petitioner is found to be entitled to the relief as claimed in the legal notice as per law, the same be released within a period of two months thereafter.
