Prayer in this Criminal Writ P etition filed under Article 226 of the Co n stitution of India is for issuan c e of directions to respondents No. 2 to 4 to protect the life and liberty of the petitioners and to restrain the private respondents No. 5 to 7 not to h a rass or interfere in the peaceful life of the p etitioners.
At the very outset, learned counsel for the State-Punjab, refers to t h e status report dated 27.04.20 2 3, filed by way of affidavit of Sh. Visha v jeet Singh Mann, Deputy Su p erintendent of Police, City-1, Bathinda, o n behalf of respondent No. 3, wherein in para No. 4, it has been state d that in pursuance to the applic a tion dated 25.02.2023, received from petit i oner No. 1, ‘the police has initiated the proceedings u/s 107/150 C r .P.C. against respondent No. 5 only vide rapat dated 25 dated

24.04.202 3 . The enquiry report was a lso approved by the S.S.P., Bathinda. T he police has taken appropria t e action in the said application of the peti t ioners. It is pertinent to ment i on here that the appeal of the private re s pondent No. 5 (against the o rder dated 02.12.2022 of the learned J M IC, Bathinda) pending befo r e the learned court of Addl. Sessions J u dge, Bathinda regarding whic h the petitioners were allegedly coming at Bathinda for appearing befor e the learned court, has been dismissed. ”
On instructions from ASI Sa t yawan, learned counsel for the State of H a ryana, submits that as on date there is no threat perception to the petitio n ers. Learned counsel also re f ers to the status report dated 27.04.202 3 , filed by way of affidavit of Sh. Kuldeep Singh, Deputy Superintendent of Police, Dabwali, D istrict Sirsa, on behalf of responden t s No. 1, 2 and 4 and the relev a nt portion of para No. 3 of the status repo r t, reads as under:-
“3. …… The petitioner wa s joined in the enquiry into the allegations in the prese n t petition and application/ representation received to lo c al Police on 11.04.2023, by SI Tara Chand, PS City Mandi Dabwali. Petitiner No. 1 has been appraised and assured by the local police that every protection would be provide d to the petitioners as and when required by the petitioners. S tatements of petitioner No. 1 was also recorded in which s he has stated that she is fully satisfied by the proceeding c onducted by Haryana Police. (English translation of co p y of statement is attached herewith). In this way there is no apprehension to the life and liberty to the petitioners fro m the private respondents and every protection shall be provided by the answering respondents to the petitione r s as when so required by the

petitioners, in future. Unde r the facts and circumstances mentioned above, present pet i tion is devoid of any merits and is liable to be dismissed.”
In view of the above facts and circumstances, learned counsel fo r the petitioner submits that the instant Criminal Writ Petition, may be dis p osed of.
