On the la s t date of hearing i.e. on 20.08. 2 024, a Coordinate Bench of thi s Court passed the following order:

“This petition has been filed under Section 438 of Cr.P.C. fo r gra n t of anticipatory bail to the peti t ioner in case FIR No.0067 date d 04. 0 6.2024 under Sections 306 and 5 06 IPC read with Section 34 IP C reg i stered at Police Station Boha, Dis t rict Mansa. The case has been called out twice. However, none has put i n ap p earance on behalf of the complain a nt.

On the last date of hearing, Mr . Abhaysher Singh, Advocate, wh o ha d filed Vakalatnama on behalf of mother of the complainant , submitted that on the next date of h e aring, he would file Vakalatnam a

on b ehalf of complainant but he has n either filed the same nor is presen t tod a y.

Learned counsel for the petiti o ner submits that plot was owne d by the uncle of the petitioner. Sukhdev Singh (Father of th e co m plainant) has died and a suicide note was recovered wherein it i s wri t ten that Sukhdev Singh, who is f ather of four daughters and a son , wa s insulted by the accused by su b mitting a false complaint to th e pol i ce station.

On asking, learned State coun s el submits that till today, nothin g has come on record during the i n vestigation that there was an y im m ediate instigation or abetting o r aiding by the petitioner whic h for c ed Sukhdev Singh to commit suic i de. There is only suicide note.

In the meantime, petitioner is d irected to join investigation as an d wh e n called by SHO/Investigating O f ficer and in the event of her arrest , she shall be released on interim bail o n his furnishing bail bonds to th e sat i sfaction of SHO/Investigating A gency, subject to the followin g co n ditions as envisaged under Sectio n 438 (2) Cr.P.C.:(i) that the petitioner shall make h imself available for interrogatio n be fo re the investigating officer as and when required: (ii) that the petitioner shall not, directly or indirectly make an y ind u cement, threat or promise to any p erson acquainted with the facts o f the case as to dissuade him from disc l osing such facts to the Court or t o an y police officer; (iii ) that the petitioner shall not leave the country without prio r per m ission of the Court concerned.”

Learned S tate counsel upon instruction s has informed that pursuant t o interim directions issued by this Court, the petitioner has since joine d investiga t ion and is not required for any c ustodial interrogation.

Having r e gard to the aforestated position , wherein the petitioner is state d to have joined investigation and is n ot required for any custodia l interroga t ion, the petition is accepted an d the interim directions issued b y this Cour t vide order dated 20.08.2024 a r e hereby made absolute subjec t
